Membership agreement

This Membership Agreement (“Agreement”) is entered into between Cannabury Social Club (“the Club”) and the undersigned Member.

By signing this Agreement, the Member acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.

1. Purpose of the Club

Cannabury Social Club is a private, members-only social club established to provide a private environment where adult members may gather, socialize, and engage in activities related to cannabis within the limits of South African law and constitutional rights.

The Club does not operate as a public cannabis retail outlet and access is restricted to registered members and authorized guests approved by management.

2. Eligibility for Membership

Membership is available only to individuals who:

• Are 18 years of age or older.
• Provide valid identification upon request.
• Agree to comply with all Club rules and policies.
• Complete the membership registration process.
• Have not been banned or excluded from the Club.

The Club reserves the right to approve, decline, suspend, or terminate membership at its sole discretion.

3. Private Club Status

The Member acknowledges that:

• The Club is a private membership organization.
• Entry is restricted to registered members.
• Membership may not be transferred to another person.
• Members may be required to present proof of membership and identification upon entry.

4. Compliance with South African Law

Members acknowledge and agree that:

• Cannabis remains a regulated substance in South Africa.
• Membership does not authorize any illegal activity.
• Members are solely responsible for ensuring their own conduct complies with applicable laws.
• The Club does not condone, encourage, or permit unlawful conduct.
• Members must comply with all applicable legislation, regulations, and court rulings relating to cannabis possession, cultivation, and private use.

5. Private Adult Use

The Member confirms that:

• Any cannabis-related activity undertaken by the Member is for private adult personal use.
• The Member understands that consumption may impair judgment and ability.
• The Member will not operate a motor vehicle or machinery while impaired.
• The Member assumes full responsibility for any decisions made after consuming cannabis.

6. Prohibited Conduct

The following conduct is strictly prohibited.

Members may not:

• Supply cannabis to persons under the age of 18.
• Permit minors to consume cannabis.
• Bring weapons onto Club premises.
• Engage in violence, threats, harassment, discrimination, or intimidation.
• Cause damage to Club property.
• Conduct illegal sales or commercial transactions on Club premises.
• Consume illegal substances on Club premises.
• Attend the Club while excessively intoxicated or disruptive.
• Resell any products acquired through the Club.
• Share membership credentials with another person.

Any breach may result in immediate suspension or termination of membership.

7. Responsible Consumption

Members agree to:

• Consume responsibly.
• Respect other members and staff.
• Follow all staff instructions relating to health, safety, and Club operations.
• Leave the premises if requested by management.

Management reserves the right to refuse entry or service to any member displaying unsafe or disruptive behaviour.

8. Health Disclaimer

The Member acknowledges that:

• Cannabis may affect individuals differently.
• The Club does not provide medical advice.
• Members are responsible for consulting healthcare professionals regarding any medical concerns.
• The Club makes no guarantees regarding individual experiences or effects.

Members consume cannabis entirely at their own risk.

9. Assumption of Risk

The Member voluntarily assumes all risks associated with:

• Cannabis consumption.
• Participation in Club activities.
• Attendance at Club events.
• Use of Club facilities.

The Member releases the Club, its owners, directors, staff, contractors, and representatives from liability for any loss, injury, illness, damage, or claim arising from the Member's actions, except where caused by gross negligence or unlawful conduct by the Club.

10. Privacy and Confidentiality

The Club may collect personal information necessary for:

• Membership administration.
• Communication with members.
• Compliance with legal obligations.

The Club will process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).

The Member consents to the collection, storage, and processing of personal information for these purposes.

11. Media Consent

The Club may occasionally photograph or record events.

Members may notify management in writing if they do not wish to appear in promotional material.

12. Membership Fees

• Membership fees, if applicable, are determined by the Club from time to time.
• Membership fees are non-refundable unless otherwise required by law.
• Membership may lapse if fees are unpaid.

13. Disciplinary Action

The Club may suspend or terminate membership where a Member:

• Violates these Terms and Conditions.
• Acts in a manner that damages the reputation of the Club.
• Endangers staff, members, or visitors.
• Engages in unlawful conduct.

Termination of membership may occur without refund.

14. Indemnity

The Member indemnifies and holds harmless Cannabury Social Club, its owners, employees, agents, and representatives against any claims, losses, damages, costs, or liabilities arising from:

• The Member's conduct.
• The Member's breach of these Terms.
• The Member's cannabis consumption.
• The Member's violation of any law.

15. Right of Admission Reserved

Cannabury Social Club reserves the right to:

• Refuse admission.
• Suspend membership.
• Remove any individual from the premises.
• Amend Club policies and rules from time to time.

16. Acknowledgement

By signing below, I confirm that:

• I am 18 years of age or older.
• I have read and understood this Membership Agreement.
• I voluntarily apply for membership.
• I agree to comply with all Club rules and policies.
• I understand that membership may be revoked for breaches of these Terms and Conditions.
